1.1 This Money Back Guarantee (Money Back Guarantee) & Refund Policy (Policy) sets out how you can return your purchase to CANDY GROUP PTY LTD (ACN 675 944 484) trading as CANDY CLAWS.
1.2 This Policy also sets out the eligibility requirements for our Money Back Guarantee and how to request a refund.
2. DEFINITIONS
2.1 Site means the website located here.
2.2 Purchased Products means any and all products purchased from our Site, to which this Policy applies.
3. MONEY BACK GUARANTEE AND REFUNDS
3.1 The terms of the Money Back Guarantee are as follows (except to the extent clause 3.4 applies, if you are a recurring customer):
(a) only one set of nails per order can be refunded, regardless of whether or not it has been opened (“Nail Set”);
(b) we will issue you a refund for the purchase price of that Nail Set, less the shipping cost;
(c) should you have ordered other nail sets additional to the Nail Set (“Non-Refunded Sets”), the Non-Refunded Sets must be in their original packaging and unopened; and
(d) a request for a refund must be made within 30 days of receiving the Purchased Products.
3.2 You acknowledge that the Money Back Guarantee does not apply to the Non-Refunded Sets.
3.3 You also acknowledge that the Money Back Guarantee is only valid for 30 days from the date of purchase of the Purchased Products.
3.4 If you are a first time customer, clauses 3.1(a) to (d) apply. However, if you are a recurring customer, you accept that all Purchased Products must be unopened and in their original packaging in order to receive a refund.
3.5 In order to request a refund, you are required to:
(a) email us at support@candyclaws.com.au with your order number and particulars regarding the reasons for the refund; and
(b) ship the Purchased Products to us within 7 days of us providing you with return instructions and confirmation.
3.6 Upon confirming the refund, we will issue the refund to you within 5-10 business days of receipt of the Purchased Products. The refund will be returned to you via the original payment method you used when placing your order.
3.7 You are solely responsible for payment of all shipping costs in returning the Purchased Products to us.
4. DAMAGED PRODUCTS
4.1 Should you receive Purchased Products which are defective or damaged, you are required to contact us promptly via the email address listed in this Policy and provide us with particulars regarding that defect.
5. EXCHANGE POLICY
5.1 We do not offer exchanges.
5.2 We recommend that you return the Purchased Products in the manner set out in this Policy and make another order once your return has been processed and refunded.
6. AUSTRALIAN CONSUMER LAW
6.1 Nothing in this Policy limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law (ACL) which by law may not be limited or excluded.
6.2 Pursuant to the ACL, you may be entitled to a refund, repair or replacement depending on the circumstances (such as whether the fault amounts to a “major failure”, as defined under s 260 of the ACL).
